NPS Explains Delay in Arrests Over Alleged Attack on Rigathi Gachagua at Witima Church

Nairobi, Kenya  The National Police Service (NPS) has broken its silence on why no arrests have been made following the alleged attack on former Deputy President Rigathi Gachagua at Witima Church.

In a statement issued on Sunday, February 15, NPS spokesperson Muchiri Nyaga said investigations are ongoing but have not progressed to arrests due to lack of formal complaints and detailed witness statements.

The clarification comes amid growing public debate online, with many Kenyans questioning the pace of investigations.

What Happened at Witima Church?

The alleged incident occurred during a church service attended by Gachagua, triggering reports of chaos and suspected violence.

Police say they launched investigations immediately after receiving reports of possible criminal conduct.

“Upon receiving reports of alleged criminal activities, the service promptly initiated investigations in accordance with the law,” Muchiri said.

According to the NPS, officers have:

Reviewed available video footage

Recorded several statements

Analysed intelligence reports

Begun identifying persons of interest

Why No Arrests Have Been Made

Despite preliminary findings, the police say arrests cannot be made without formal complaints and comprehensive witness accounts.

“The success and speed of the process depend significantly on formal reporting, detailed witness accounts, and the cooperation of complainants and members of the public,” Muchiri stated.

He noted that investigations based purely on publicly circulated videos and social media content limit the ability to build prosecutable cases.

Legal experts note that under Kenyan criminal procedure, investigators must compile admissible evidence before making arrests that can withstand judicial scrutiny.

NPS Reaffirms Neutrality

The police service emphasised its commitment to impartiality and adherence to the Constitution.

“The service remains firmly committed to impartiality, professionalism and adherence to the rule of law. We reiterate that the NPS serves all Kenyans without fear or favour,” the spokesperson added.

The statement appears aimed at calming political tensions, as the incident has sparked strong reactions from leaders and supporters across the political divide.

Political and Security Implications

The case raises broader concerns about:

Security at political gatherings

The role of citizen cooperation in criminal investigations

Public trust in law enforcement institutions

Analysts say how the matter is handled could shape public perception of police independence, especially ahead of heightened political activity in 2026.
